1. About these terms
These terms apply to every order placed on this website (the "Site"), which is operated by Maai Bakehouse Ltd ("we", "us", "our"), a company registered in England and Wales under company number 17142761, with its registered office at 15 Rigby Avenue, Blackburn, BB2 7GX. Please read them before you order. By placing an order you agree to them.
We sell to consumers buying for their own use. Nothing in these terms affects your legal rights as a consumer, including your rights under the Consumer Rights Act 2015.
2. Our bakes
Everything we sell is baked to order. Bakes are made by hand, so size, shape and finish vary slightly from box to box and from the photographs on the Site, which are for illustration. The bakes in each box change with the seasons, and the product page shows what is in the box at the time you order.
The allergens in each box are listed on its product page. Our kitchen handles nuts, gluten, dairy, eggs and soya, so we cannot guarantee that any bake is free from them. If you or the person you are sending to has a severe allergy, please contact us before ordering.
3. Placing an order
You choose your box, and your dispatch date, on the Site, and pay on Shopify's secure checkout. Your order is an offer to buy. A contract between us is formed when we send the email confirming your order.
We may decline or cancel an order if we are unable to fulfil it, for example if a dispatch date is no longer available or an ingredient cannot be sourced. If we do, we will tell you and refund any payment in full.
4. Prices and payment
Prices are shown in pounds sterling on the Site and are the prices that apply on the day you order. Payment is taken at checkout by Shopify. We never see or store your card details.
Delivery is £4.50 per order, and free on orders over £40. The delivery charge is shown in the bag and at checkout before you pay.
If a product is listed at a price that is clearly wrong, we will contact you before dispatch. You can then confirm the order at the correct price or cancel it for a full refund.
5. Dispatch and delivery
We deliver to addresses in the United Kingdom only. Orders are dispatched on Tuesdays and Fridays, on the dispatch date you choose in your bag, by Tracked 24 delivery. You receive a tracking link by email once your order has been dispatched.
We do not guarantee a delivery time after dispatch, and we are not responsible for delays caused by the courier or by events outside our control. If your order is delayed, contact us and we will help.
Please check the delivery address carefully, including for gifts. Because our bakes are perishable, we may not be able to replace or refund an order that cannot be delivered because the address given was incorrect or incomplete.
6. The monthly box
The monthly box is a rolling plan with no minimum term. You pay for your first box at checkout, and it is dispatched on the date you choose. Later boxes are charged each month on the date you ordered and go out on the first Tuesday or Friday at least two days after that. Each box is charged at the monthly price shown when you signed up, plus £4.50 delivery, which is free when that month's order is over £40.
You can skip a month, pause or cancel at any time, free of charge, from your account at account.maaibakehouse.co.uk. Changes made before your next billing date apply to that month's box. Once a month's box has been charged, it is baked for you and cannot be cancelled.
If we change the price of the monthly box, we will email you at least 14 days before the new price applies, so you can cancel first if you wish. We may end a plan by giving you notice by email, and you will not be charged for any box after it ends.
7. Gift messages
Gift messages are written out by hand exactly as you enter them, up to 200 characters. We may decline to write a message that is offensive or unlawful, in which case we will contact you before dispatch.
8. Changes, cancellations and returns
Our bakes are perishable and made to order, so the 14 day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply to them, and we cannot accept returns.
If you need to change or cancel an order, email us as soon as possible. We will do our best to help, but once an order has been baked it cannot be cancelled.
9. If something is wrong with your order
Our bakes are made by hand and sent by post, so a little movement on the way is normal: a few crumbs, a cracked top or a topping that has shifted. This does not change how they taste and does not count as damage. If your order arrives damaged, is incorrect or is not of the standard you expect, email us within 24 hours of delivery with your order number and a photo. We will arrange a replacement or a refund. This does not limit your legal rights if the goods are faulty.
10. Storage
How to store each box, and how long it keeps, is on its product page. We are not responsible for bakes that deteriorate because they were not stored as directed or were kept beyond those times.
11. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. Our bakes are sold for domestic and private use, and we are not liable to you for any business losses.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
12. The Site
The text, photographs and designs on the Site belong to us or are used with permission. You may not copy or reuse them without our written consent. How we handle personal data is set out in our privacy policy.
13. Changes to these terms
We may update these terms from time to time. The terms that apply to your order are the ones on the Site when you place it. For the monthly box, we will email you before any change that affects your plan.
14. Law
These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of the country where you live.
